Conditions of Use of Online Booking

Please read these Conditions of Use of Online Booking carefully before using the web site.

This Web Site is owned by Malindo Airways Sdn Bhd (doing business as Batik Air). By using this Web Site, you indicate your agreement to be bound by these Conditions of Use. If you do not agree to any part of these Conditions of Use, do not use this Web Site.

1. Formation of agreement


  1. www.malindoair.com and www.batikair.com.my ("the booking facility") is owned and operated by Malindo Airways Sdn Bhd (doing business as Batik Air). When you use the booking facility to make a reservation, you signify your agreement to these Conditions of Use and other applicable terms, conditions, and notices, including but not limited to the Conditions of Use of Web Site. If this is not your intention and you disagree with any part of these Conditions of Use or such other applicable terms and conditions, DO NOT USE the booking facility. You should obtain a print-out of these Conditions of Use for your records.
  2. The information contained in the booking facility may change without notice. Batik Air does not warrant nor represent the accuracy or completeness of the booking facility or any of the data or information contained in the booking facility.

2. Personal and non-commercial use limitation


  1. The booking facility is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the booking facility.

3. Use of Batik Air Booking Facility


  1. Batik Air Booking Facility is solely to assist you in determining the availability of travel-related goods and services and to make legitimate reservations or purchases for yourself and those travelling with you. Abuse of the booking facility may result in, amongst other things, your being denied access to it.
  2. Other terms and conditions will apply to your reservation and purchase of travel-related goods and services. You will abide by the applicable terms or conditions of purchase, including payment of all amounts when due and compliance with all rules and restrictions regarding availability of fares, products, or services. You are solely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the booking facility.
  3. You will use Batik Air Booking Facility to make only legitimate reservations.

4. Booking rules


  1. Reservations are subject to the applicable fare conditions and the seat vacancies in that fare group.
  2. You must pay at the time of reservation. Fares and taxes will be quoted and charged in the currency displayed in the fare quote. Credit cards issued by Visa, MasterCard, Diners and American Express may be used for reservations. However, these credit card options are not available in every departure city. For these purposes only, the booking facility shall be deemed to be based in the country of your departure city.
  3. Infants (under 2 years at the time of travel) and children (2 to below 12 years at the time of travel) must travel with an accompanying adult. Tickets booked through Batik Air Booking Facility must be made under the same reservation.
  4. For Electronic Ticket, you must present the credit card that was used to purchase the Ticket and your passport at check-in. If you fail to produce the purchasing credit card for verification, Batik Air reserves the right to deny the ticket holder(s) from boarding.
  5. Carriage and other services performed by Batik Air are subject to the Batik Air Conditions of Contract and Notices and General Conditions of Carriage, as amended by these Conditions of Use, which form part of and are to be read together with the Conditions of Contract and Notices and General Conditions of Carriage. By making a reservation through Batik Air Booking Facility, you agree to be bound by the Batik Air Conditions of Contract and Notices and General Conditions of Carriage and these Conditions of Use. These documents are available on Batik Air Web Site.

5. Travel requirements


  1. You may require a visa for travel to some destinations. It is your responsibility to obtain this visa. You must have a valid passport for the duration of your trip and the expiry date must be acceptable in all the countries you enter. More information on passport and visa requirements is available at the embassy of the country or countries you will be travelling to, and the local Batik Air office.
  2. Fares may not include all airport and passenger taxes which must be paid by each passenger. Such information may be quoted with the fare, and included in the total due.
  3. Some airports have passenger service charges which will be paid by the passenger at the airport. Information on these charges is not given in this Web Site.
  4. Certain taxes, fees and passenger service charges, which are incorporated into your ticket and collected at the time of ticket issuance, are refundable in the event your ticket is not utilised. Please approach your local Batik Air office to obtain the refund.

6. No unlawful or prohibited use


  1. You will not use this Web Site for any unlawful or prohibited purposes. You will not use Batik Air Booking Facility to make any unauthorized, speculative, false or fraudulent reservation.
  2. You must not:
    1. resell the service of Batik Air Booking Facility; or
    2. use Batik Air Booking Facility for any activity which breaches any law; or
    3. use Batik Air Booking Facility in a way which interferes with its availability for other users; or
    4. use other means to transact or obtain information if you are unable to use Batik Air Booking Facility.
    If Batik Air (in its sole discretion) believes that you are in breach, or will be in breach, of any of these Conditions of Use, Batik Air reserves its right to cancel your booking without giving you a reason and/or without further reference to you.

7. Restrictions on use


  1. Batik Air and its licensors retain all rights (including trademark, copyright and patent rights) with respect to all software and underlying information and material available through Batik Air Booking Facility. You must not download or otherwise export or re-export any software or underlying information or material available through Batik Air Booking Facility except with the written permission of Batik Air and in full compliance with all Malaysian and other applicable laws and regulations. In particular, but without limitation, you must not download or otherwise export or re-export any software or underlying information or material available through Batik Air Booking Facility unless such downloading occurs in the course of using Batik Air Booking Facility in accordance with the written instructions of Batik Air.

8. Age and responsibility


  1. You represent that you are of legal age to use the booking facility in accordance with these Conditions of Use and to create binding legal obligations for any liability you may incur as a result of the use of the booking facility and this Web Site. You are financially responsible for all uses of this Web Site by yourself and those using your login information. You will supervise all usage of the booking facility under your name or account. You warrant that all information supplied by you and members of your household in using the booking facility are true and accurate.

9. Disclaimer


  1. Batik Air Booking Facility is provided "as is" and you assume total risk and responsibility for your use of the booking facility and the global computer network including the submission of any personal or business information. To the maximum extent permitted by law, Batik Air specifically disclaims and you waive all warranties, express or implied, in respect of the booking facility including merchantability, fitness for a particular purpose, non-infringement of intellectual property or other proprietary rights or compatibility between Batik Air Booking Facility and any software or hardware.

10. No representation


  1. Batik Air does not warrant or represent that your access to and/or use of Batik Air Booking Facility will be uninterrupted or error-free or that any information, data, content, software or other material accessible through Batik Air Booking Facility will be free of bugs, viruses, worms, Trojan horses or other harmful components.

11. Limitation of liability


  1. To the maximum extent permitted by law, Batik Air is not liable for any injury, loss, claim, damage, including those based in negligence, whether actual, incidental, special, exemplary, punitive or consequential (including lost profits or other special damages) which arises out of or is in any way connected with any of the following items:
    1. access or use of Batik Air Booking Facility;
    2. data, information or material contained in Batik Air Booking Facility including the use of such data, information or material to check prices and availability or for reservations, ticketing or any other use;
    3. submission of any personal or business information, including bank and credit card details;
    4. unavailability of Batik Air Booking Facility to you in whole or in part or any failure or delay in any way connected with the use of the booking facility because of the global computer network, ancillary equipment, the systems of Batik Air systems or technology or any other circumstances, including the use of or inability to use Batik Air Booking Facility to check prices and availability or for reservations, ticketing or any other use;
    5. the performance or non-performance by Batik Air or the failure of any function or service associated with Batik Air Booking Facility, in whole or in part;
    6. any unauthorised access or breach of security into Batik Air Booking Facility through the global computer network; and
    7. any booking or reservation made through the Singaporeair.com booking facility that has not registered or is incomplete or is delayed or is in error.
    If Batik Air is found liable for any loss or damage which arises out of or is in any way connected with any accessing or use of Batik Air Booking Facility then the liability of Batik Air will in no event exceed, in the aggregate, any subscription fee and/or service charge for accessing Batik Air Booking Facility.

12. Cancellation or suspension of service


  1. Batik Air may cancel or suspend your use of Batik Air Booking Facility at any time without notice if Batik Air suspects that the booking facility Number and Password/PIN is being used, or may be used:
    1. by persons that have not been authorised by you; or
    2. by persons that have not been authorised by you; or
    3. in a manner that may cause loss to you or Batik Air. Batik Air may, at any time and at its sole discretion and without cause or notice, terminate or restrict your access to Batik Air Booking Facility or refuse to give effect to any reservation you request through the booking facility without giving any reason or notice to you.

13. Security


  1. Batik Air will take all reasonable measures to ensure that information you transmit to Batik Air using Batik Air Booking Facility will remain confidential and protected from unauthorised access but Batik Air does not warrant against unauthorised access and will not be liable for any unauthorised access by any means to that information.

14. Jurisdiction


  1. This Agreement is governed by the laws of the Laws of Malaysia and you agree to submit to the exclusive jurisdiction of the courts of Malaysia.
